Terms of use
Last updated: October 2, 2026
1. Purpose and acceptance
These terms of use define the conditions for accessing and using the thelastcommit.com website (the "Site"). Accessing and using the Site implies unreserved acceptance of these terms. We may change them at any time; the applicable version is the one online at the time of your visit.
2. Publisher and host
The Site is published by The Last Commit, a French simplified joint-stock company (société par actions simplifiée) with a share capital of €4,000, registered with the Versailles Trade and Companies Register (RCS) under number 130 940 141, with its registered office at 11 rue du Fer à Cheval, 78120 Rambouillet, France. Publication director: Emilie Frochtmann, President. Contact: contact@thelastcommit.com. The Site is hosted by Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, United States (vercel.com). The API, database and storage associated with the Site are hosted by Scaleway SAS, 8 rue de la Ville-l’Évêque, 75008 Paris, on servers located in France.
3. Access to the site
The Site is freely accessible and requires neither an account nor authentication. It presents our Go To Prod service offering, our in-house SaaS products and a few playful features (terminal, Merge Rush mini-game). We may change, suspend or interrupt access to the Site or to any of its features, in particular for maintenance or technical evolution, without notice or compensation.
4. Contact form and submitted content
The Site offers a contact form and a project enquiry form. You undertake to provide accurate information and not to submit any unlawful or defamatory content, or content infringing third-party rights.
5. Merge Rush game and leaderboard
The Site offers a mini-game, Merge Rush, which anyone can play. At the end of a game, you may add your score to the leaderboard under a nickname of your choice; this nickname is public and visible to all visitors. We advise you not to use your full name. The nickname must not refer to another person, nor contain abusive, discriminatory, unlawful or promotional content. We may refuse or remove without notice any nickname or score that breaches these terms or was obtained by circumventing the game (implausible score, automated submission), and reset the leaderboard at any time. The leaderboard is neither a contest nor a lottery: it gives no right to any prize or reward. The data recorded with a score and how long it is kept are described in our Privacy Policy.
6. Intellectual property
All elements of the Site — text, visuals, logos, trademarks, code, visual identity — are protected by intellectual property law and remain the exclusive property of The Last Commit or its partners. Any reproduction, representation, adaptation or reuse, in whole or in part, is prohibited without prior written authorisation, with the exception of short quotations accompanied by a link to the source.
7. Third-party services and websites
The Site links to our SaaS products (Memojin, Aukilo, Vitef, JuryDay) as well as to third-party platforms, in particular our social media accounts. These services have their own terms of use and privacy policies, over which we have no control and which we invite you to read.
8. Liability
Information published on the Site is provided for information purposes and may change without notice. It does not constitute a contractual offer: every engagement is subject to a quotation and to our terms of sale. We cannot be held liable for any unavailability of the Site, for any error or omission in its content, or for indirect damage resulting from its use.
9. Personal data and cookies
The processing of personal data and the use of cookies are described in our Privacy Policy. No audience measurement cookie is set without your consent, which you can change at any time through "Manage my cookie choices" in the footer.
10. Governing law
These terms of use are governed by French law. In the event of a dispute, an amicable solution will be sought first; failing that, the French courts shall have sole jurisdiction. This English version is provided for information only; the French version prevails.
